Terms of Use
Effective: September 20, 2026 / Last updated: October 2, 2026
These terms apply to “KATACHI,” “Keep In Touch,” “Graph,” “One CRM” and “Utility” (the “Apps”) provided by Keisuke Sugimoto, doing business as Pohoda (“we,” “us”). By using an App you agree to these terms. Apple’s standard Licensed Application End User License Agreement also applies; if the two conflict, Apple’s applies to the extent required.
1. Licence
We grant you a personal, non-exclusive, non-transferable licence to use the Apps on Apple devices you own or control, as permitted by the App Store Terms of Service.
2. Acceptable use
You must not: break the law; reverse engineer or decompile an App; use an App to harass, stalk or otherwise infringe the rights of others; infringe intellectual property or privacy rights; or interfere with the operation of an App.
3. Other people’s information
Some Apps let you record information about other people (contacts, customers, photos). You are responsible for collecting and recording it lawfully and for not using it to infringe anyone’s rights. If you use an App for business, you are responsible for complying with the privacy, marketing and data-protection laws that apply to you.
3A. One CRM team sharing (Japan only)
- The “Use as a team” feature (sharing a business) is offered only on the Japanese App Store, to users with Pro. Each participant also needs their own Pro; one purchase cannot be shared among several people.
- The person who shares (the “Owner”) chooses participants at their own responsibility and, for the data they share (including information about customers and other third parties), is responsible for obtaining any necessary consent and taking security measures required by applicable law.
- When the Owner removes a participant or stops sharing, the business disappears from that participant’s device. Files the participant exported, screenshots and any other data taken outside the app are not deleted. Returning or deleting data when a participant leaves is a matter between the Owner and the participant, and we are not responsible for it.
- Shared data is stored in the Owner’s iCloud. Editing or sharing a shared business may become unavailable because of the Owner’s iCloud storage or account status, a change of App Store region, or the end of a Pro plan (viewing and exporting remain possible).
- If several people edit the same record at nearly the same time, one person’s change may not be kept.
4. Not medical or professional advice
KATACHI and Utility help you log workouts and body measurements (Utility also logs BMI, shown without any classification or advice). Neither provides medical, health, nutrition or fitness advice, and neither is intended to diagnose, treat or prevent any condition. Consult a qualified professional before starting or changing an exercise or diet programme, and stop if you feel pain or discomfort. Outputs of any AI feature (which run on your device on supported hardware) may be inaccurate; check them before relying on them. Graph, One CRM and Utility’s notes, tasks and calendar features are record-keeping and organisational tools and do not provide financial, tax, accounting or legal advice.
5. Purchases and subscriptions
Paid plans are sold through the App Store. Prices are shown in the App Store in your local currency. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically at the same price unless you cancel at least 24 hours before the end of the current period; you can manage or cancel in your device’s Settings > your name > Subscriptions. Lifetime purchases are one-time payments with no renewal. Refunds are handled by Apple under its policies. If a subscription lapses, your recorded data stays on your device.
6. Availability and changes to the Apps
The Apps are offered in selected countries and regions and are not currently offered in the European Economic Area. We may change, suspend or discontinue features, and we will try to give notice of significant changes. You must not use the Apps where prohibited by sanctions or export-control laws.
7. Disclaimer
To the extent permitted by law, the Apps are provided “as is” and “as available,” and we don’t promise they will be uninterrupted, error-free or suited to a particular purpose. You are responsible for backing up your data; because data lives on your device, deleting an App or losing a device can permanently remove it unless you have made a backup.
8. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of data, profits or business, arising from use of the Apps, except where caused by our intent or gross negligence. Nothing in these terms limits liability that cannot be limited by law (for example for death or personal injury caused by negligence, or fraud).
9. Consumer rights
If you are a consumer, you may have legal rights that can’t be waived by contract. These terms do not affect those rights.
10. Privacy
How information is handled is described in our Privacy Policy.
10A. Apple
These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the Apps and their content. In addition:
- Scope of licence. The licence is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service, and is non-transferable.
- Maintenance and support. We are solely responsible for support. Apple has no obligation to provide maintenance or support for the Apps. See our Support page.
- Warranty. If an App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for that App. To the maximum extent permitted by law, Apple has no other warranty obligation for the Apps; any other claim, loss or expense attributable to a failure to conform to a warranty is our responsibility.
- Product claims. We, not Apple, are responsible for addressing your or any third party’s claims relating to an App or your possession or use of it, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- Intellectual property claims. If a third party claims that an App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging the claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with applicable third-party terms (for example your wireless carrier’s) when using an App.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
- Developer contact. Keisuke Sugimoto (Pohoda), Japan. Email: pohoda.inc@gmail.com.
10B. Intellectual property and takedown requests
We respect the rights of others. If you believe that an App’s name, icon, content or any other material infringes your trademark, copyright or other rights, email us at pohoda.inc@gmail.com with your contact details, the right you own, and the material you are concerned about. We review requests promptly and, where a claim appears well founded, we will change or remove the material (including, where necessary, renaming the App).
11. Changes to these terms
We may change these terms only where the change is in the general interest of users, or where it does not conflict with the purpose of these terms and is reasonable in light of the need for the change, the appropriateness of the new terms and other relevant circumstances (Article 548-4 of the Civil Code of Japan). Before a change takes effect, we will announce the updated terms and their effective date on this site or by other appropriate means, at least 14 days in advance unless the change only benefits users. Continued use after the effective date means you accept the updated terms.
12. Governing law and disputes
These terms are governed by the laws of Japan, without affecting any mandatory consumer-protection law of the country where you live. Where the law allows, disputes will be brought in the courts of Japan with jurisdiction over our location; this does not limit any right you have to bring a claim in the courts of your place of residence where mandatory law gives you that right.
